Your statutory rights shall remain unaffected by these Terms and Conditions, and except in accordance with these Terms and Conditions all purchases are non-exchangeable, non-refundable and non-transferable.

Same day deliveries are guaranteed within London for orders that have been placed before 2:30pm GMT. For all other services, your order must be placed by 1pm GMT to ensure that your order is processed for dispatch on the same day.

Please note that if you place an order after the cut-off times mentioned above, your order will be processed and dispatched on the following business day. Orders placed after the cut-off time on a Friday will be processed for dispatch on the following Monday.

Our Premium UK service is especially recommended if you would like to have your items delivered to your home in the morning before work. However, if you will be at work at that time, choosing the Standard UK service and delivering them to your office may be a more convenient delivery option for you. As we are unable to redirect orders after dispatch, please always double check the address you give at checkout is a destination you will likely be at upon delivery. All orders will require a signature upon receipt.

We will aim to dispatch the goods ordered as soon as possible after we have verified the availability of goods, your billing address and all the card fraud checks have been cleared. If your order has not been delivered within the timeframe specified at point of your confirmation email, we will aim to rectify the situation as quickly as practically possible.

Please note that dispatch estimates are just that. They are not guaranteed dispatch times and should not be relied upon as such. As we process your order, we will also make sure we inform you as soon as possible if any products you ordered turn out to be unavailable.

2.3. Passing of property and risk

Entitlement to the products is passed to you on the date we receive full payment for the products ordered. Legal ownership of the items will immediately revert to Temperley London if we refund any such payment to you.

Once a product has been delivered to and received by you, all risk of damage to, or loss of the product shall pass to you.

Liability of returned goods shall remain with you until we receive them.

3. Terms of sale

3.1. Placing your order

Temperley London offers you the chance to buy directly from the runway looks seen in Collection > Season. Alternatively, you can go straight into Shop and purchase online by product category.

Purchasing from the Site can be done by interacting with the picture gallery of products by clicking on them to see more. The full-screen zoom functionality is great for seeing the design of garments, embellishments and fabric up close. Having selected the desired size and colour, simply click Add to Shopping Bag. Please then look to the top right-hand corner of the screen for My Shopping Bag where you will be able to view and edit your selection and proceed to checkout. You can also skip the Basket view and go directly to Checkout.

In the event prolonged inactivity causes your connection to our Site to fail, your selection of items in your Basket may be lost. In the case of this happening, you will need to re-select your preferred products.

Please note that items placed in your Basket will not be reserved for you until you have confirmed and submitted your order request. This means that someone else online may buy a product you had selected for your rail if they complete the checkout process before you do. Availability of stock is not guaranteed until point of warehouse picking of stock.

Before you submit your order, you will be given the opportunity to review an order summary, check the total price of your order and correct any input errors.

Once you have made your choice and have placed your order, you will receive an email acknowledging receipt of your order. This is not a confirmation of your order. In an unlikely event of you receiving a confirmation that we cannot fulfill - we will immediately refund any settled payments.
We will send out a second email confirming dispatch which will confirm your order is on its way. This email includes your personal order reference and a FedEx tracking number. As a security precaution, a copy of the invoice and order summary listing the contents can be found in each order package.

3.2 Prices

Prices shown on the Site are stated in British pounds sterling, Euros and US dollars, depending on the customer location, quoted at the current rate. Please be advised that these are approximate conversions and that each current is subject to a general fluctuation depending on the exchange rate at the time it was entered.

Temperley London may vary the prices listed on this website at any time and without any notice.
3.2.1. Tax, Customs and Duty

All prices indicated for UK and EC customers on our site are inclusive of UK Value Added Tax (VAT), currently set at 20%. Changes in VAT will be taken into account and may alter prices shown online for UK and EC customers. All prices indicated for Rest of World customers on our site are exclusive of UK Value Added Tax (VAT).

All countries are shipped to on a DDU (Delivery Duty Unpaid) basis, meaning product prices are displayed exclusive of all import duties, customs and local sales tax levied by the delivery destination country. As the recipient, you will be liable for all import duties, customs and local sales taxes imposed by the country being shipped to, payment on these is necessary in order to release your order from customs on arrival. Be aware that this may delay your delivery time as goods held at customs will be your responsibility to pay.

If you are buying from outside the UK, you may also incur duties levied by the jurisdiction to which you have specified delivery. As custom rates tend to fluctuate regularly we will not quote for exact duty to be paid upon reception of goods. You can instead find an estimation of expected duty in your country on our site under www.temperleylondon.com/duty.

Delivery charges are calculated according to the size, weight and destination of your order. The exact delivery charges for your specific order will be listed at the end of the online checkout process before you submit your order.

3.3 Payment

It is very important that you note that the billing address you state upon checkout is an exact match of the address to which the card you are paying with is registered to. Fraud checks are set to halt any orders that fail to comply with this requirement.

You can pay for your order with Visa, Master card, American express, Delta and Switch debit and credit cards.

All transactions on this website are processed using Secure Trading and/or PayPal, secure online payment gateways that encrypt your card details in a secure host environment.

The card issuer will then perform verification checks and by consequence in the event of card refusal, we will contact you by email or phone advising you of this. We may not accept your order if an item ordered is out of stock, we are unable to obtain authorization for your payment or if we identify a product or pricing error. We also reserve the right to reject any offer to purchase by you at any time and at our sole discretion.
3.3.1. Payment upon dispatch of delivery

We aim to dispatch all orders placed before noon (12pm GMT) on the day of the order placement, Monday to Friday. Although we do give you an estimation of delivery time, we ask you to however allow up to five working days in the event of external factors, stock availability and payment authorisation causing eventual delays.

By UK law, we do not take payments until we have verified the availability of stock in the warehouse. You will only be charged for products which have been dispatched to you, together with the relevant delivery charges and any card processing charges.
3.3.2 Cancellations

Customer satisfaction is always our top priority and as such we handle each query on an individual basis to the best of our ability. If you notice that you accidentally made a mistake while placing your order and wish to cancel your order, call our online team on +44 (0)207 229 7957 for assistance.

3.4 Online Security

Temperley London aim to minimise the threat of online fraud on our Site and therefore collaborate with UK's leading independent payment processor, Secure Trading, a fully accredited Level 1 compliant provider - the highest level of compliance - under the Payment Card Industry Data Security Standard (PCI DSS).

To protect you against online card fraud, our payment processor uses password-protected identity-checking CVV entry and 3D secure. To ensure that your personal bank codes and data is kept safe while shopping online we also use pci dss compliance.

If the issuer of your card refuses to authorise payment we will not accept your order. In this case, we will then contact you via the telephone number you provided at point of checkout. By using a third party payment processor we ensure that your personal bank details are kept safe whilst shopping online. We thus store no bank card details on our customers. However, we do create a unique customer account for each of our online clients in order to be able to better respond to our customers' unique needs.

When placing an order with us for the first time, you will be required to register with us and complete certain required fields on an order form. We may provide you with and/or ask you to use passwords and other means for you to be able to access certain areas of the Site such as My Account. Where there is a legal obligation to do so, we may disclose your information to any relevant regulatory body. We do not sell your details onwards to for example third party marketing companies.

Where Temperley London promotes special events, limited edition products or online competitions and email address data is collected, these will automatically be included in our regular newsletter subscription service. 5. Returns & Exchanges


5.1. Standard Returns and Exchange Process

At Temperley London we are committed to ensuring the highest level of service.
Whilst hoping that you are delighted with your order, if you are not perfectly satisfied with your goods we will gladly offer you a full refund or exchange. We must however stress that in order to receive a refund or exchange, the item(s) must be unworn and in perfect condition, with all garment tags still attached and in their original packaging.

Please note: goods purchased online can only be accepted as returns via our Online Boutique and will not be refunded at any of our worldwide boutiques or stockists. All returns, whether for products sold at full price or sale price, must be arranged through our Website. Import duties, customs and local sales taxes are non-refundable.

Temperley London proudly offers a free returns service with FedEx International Priority.

    Returns requests are required to be initiated within 10 days of receipt of your order.

    Sale returns requests must be initiated within 5 days of receipt of order.

    Exchange requests are required to be initiated within 28 days of receipt of your order.

    Sale exchange requests must be initiated within 10 days of receipt of your order.

    Please note, upon receipt of your Returns Number, you will have 3 days to dispatch your returns shipment.

We recommend that you ensure all the items you wish to return are included in one return delivery. Kindly note that returns shipped subsequently after the initial free return will be accepted, however the customer will be liable for shipping and any additional charges. Please note that our free returns service only covers shipping charges. Customers outside the UK are liable for any additional import duties, customs and local sales taxes. Please refer to 3.2.1 Tax, Customs and Duty for more details.

FedEx will guarantee that the package arrives safely and on time. Therefore only returns sent using our chosen courier company FedEx will be accepted. Goods returned by any other means such as standard post or other courier services are not advised as Temperley cannot be liable for any loss or damage to such deliveries.
Please note that our Returns Policy for Sale Items is the same as above except that returns requests for all items bought in our online sale are to be initiated within 5 days of the date you received your
delivery.

5.2. Making a Return

Note that our returns process differs slightly depending on where you live. Please take a moment to read up on.
5.2.1. UK Resident Returns

Returns requests are completed online so please take a moment to log in to your personal Temperley online account at www.temperleylondon.com/myaccount. This will bring up a page listing your past orders as well as your personal details. Please note we do not store any bank card details on our site.
If you wish to return any goods, please initiate your online request within 10 days of receipt of your order. The countdown on the right-hand side of your orders summary will show you the amount of days left you have to request a return.
Please select Return Items to be taken to the Returns Request Form. Here you can select the items you wish to return by ticking the selection boxes.
By default, FedEx will pick up the returns parcel from the same address your order was delivered to. If you wish to change the place of pick up, please edit the address and any contact detail changes directly in the form. Please also select a preferred collection date. Kindly note, FedEx's business hours for pick ups are Monday-Friday 9am-5.30pm.
Submit your Returns Request and wait for a confirmation email, restating a summary of the items being returned, your unique Returns Number as well as the collection date.
If the Returns Request has been completed correctly, you should receive our email within 1 working day. If any of the information stated in the confirmation email is deemed incorrect, please call our Online Customer Services at 44(0)207 313 4756 to revise.
5.2.2. International Resident Returns

Returns requests are completed online, so please take a moment to log in to your personal Temperley online account at www.temperleylondon.com/myaccount. This will bring up a page listing your past orders as well as your personal details.Please note we do not store any bank card details on our site.
If you wish to return any goods, please initiate your online request within 10 days of receipt of your order. Upon receipt of your Returns Number, you will have 3 days to dispatch your shipment. The countdown on the right-hand side of your orders summary will show you the amount of days left you have to request a return.
Please select Return Items to be taken to the Returns Request Form. Here you can select the items you wish to return by ticking the selection boxes.
By default, FedEx will pick up the returns parcel from the same address your order was delivered to. If you wish to change the place of pick up, please edit the address and any contact detail changes directly in the form.
Submit your Returns Request and wait for a confirmation email, restating a summary of the items being returned as well as the Unique Returns Number issued by us.
It will be your responsibility to contact FedEx customer services, by visiting http://www.fedex.com/?location=home and choosing your country from the drop-down list. Please then arrange a convenient pick up date and time for your returning shipment. Kindly note, FedEx's business hours for pick ups will be dependent on your location.
Once FedEx comes to collect your parcel, you will be required to fill in an Airways bill form with the info provided from our customer services.
If the Returns Request has been completed correctly, you should receive our email within 1 working day. If any of the information stated in the confirmation email is deemed incorrect, please call our Online Customer Services at 44(0)207 313 4756 to revise.

5.3. Refunds & Store Credit

We strive to arrange for your refund within 14 days of the date of cancellation notice. All undamaged, correctly returned products will be credited to the original purchaser's credit card including sales taxes for all EU country shipments, excluding shipping charges. As previously stated, Temperley London is not liable for international customs duties and sales taxes, which are non-refundable for shipments outside the European Community (EU).
If you have been given a gift that was ordered from and you wish to return to the Temperley London online store, we are unfortunately unable to give you the refunded money as refunds will only be credited to the purchaser. However, you are welcome to return the undesired gift in exchange for online store credit with us. In this event please email us at online@temperleylondon.com.
If you have been endorsed an online store credit, this will be given to you in the form of a numbered code. At point of checkout, please enter this code into the field for promotional codes and the system will log and recalculate your order total and the remaining store credit, should there be any residual. By logging into www.temperleylondon.com/myaccount you can also check your remaining online store credit.
5.4. Faulty Goods

Temperley London prides itself on outstanding quality and design. We have an especially dedicated team who regularly conducts quality checks of stock and verify the good condition of products. If you for some reason suspect that you have received a product with some kind of flaw, we are however very keen to have a look at it ourselves. Please therefore return your product in the same way as stated above, free of charge so that we can assess, if proven flawed, and refund your card the full amount paid at purchase. In addition to this, we will refund the postage that you were charged when purchasing the item.
6. Order Cancellations

7. Product Care

Special care has been taken in assuring that the colour of all products on our website matches the real product colour as accurately as possible. As different computer resolutions may indicate slight variation in sharpness and clarity of the colours, we are unable to guarantee the exact product colour as seen on screen.

Where the garment is made from silk, slight variations in fabric and colour are due to the natural characteristics of the silk fibre. Subtle differences like these add to the garment's unique quality and beauty and should not be considered faults.

Our knitted products are hand crafted and each garment possesses unique variances. To uphold its shape and character, please fold the knitwear; do not hang. Be gentle to your garment and cautious near sharp objects or jewellery.

Please note that our accessories and bags are only made from the finest leathers where markings or shading in surface colour and texture are to be expected. These are unique qualities and inherent characteristics of real leather and should not be considered as faults. We recommend you do not attempt to clean your leather jacket or bag yourself, instead turn to a specialist leather and suede expert. Even though you may have turned to a professional cleaner, cleaning a leather product may result in some change in texture and colour. In order to preserve colour and condition, store away from sunlight preferably in one of the dust bags provided and do not use household detergents on your product.

If the garment contains embroidery or beading, slight variations of these are due to the expected characteristics of the semi-precious stones, beads as well as the garment's handcrafted nature. These subtle differences, again, add to the garments unique value and exquisiteness and should not be considered faults. Where the fabric used is labelled delicate, we would advise against your wearing heavy jewellery or accessories in the case that they damage or snag the fabric.

We further advise you to carefully read specific recommendations for dry cleaning, found on a tag inside each garment, making sure professional dry cleaners are aware of and can comply with the advised cleaning cycles and standards.

By taking greater care of your Temperley products, you can ensure their longevity.
7.1. Exclusivity

All prints, embroideries and embellishments are designed in house by Temperley London and are hence exclusive property to our brand.

Temperley London prides itself on sourcing only the best silks, leathers, laces and other materials from around the world. As beads are individually sourced, no two beads are exactly identical.

9. Competitions and special offers
9.1 Temperley Gift Coin

The Temperley Gift Coin is not a cheque guarantee, credit or charge card. The minimum amount required to active the Temperley gift coin is £250.00.

You may use the Temperley gift coin to make purchases from the following locations only: London, Bicester, LA.

To redeem online please contact e-commerce customers services: online@temperleylondon.com or Monday - Friday 9am-5:30pm GMT +44 (0)20 7313 4756. To redeem in store the coin must be presented to staff along with accompanying voucher.

The Temperley gift coin can be loaded with GBP, EUR or USD. London and Bicester stores can issue coins only in GBP; but can accept coins in all three currencies. LA store can issue and accept coins only in USD. Online, coins are issued (issue currency is dependent on geographical location) and accepted in GBP, EUR & USD.

Should the Temperley gift coin be redeemed in a currency different to that which it has been loaded, purchases will be converted to the loaded currency at the daily 'typical ATM' exchange rate as published by www.oanda.com. Temperley reserves the right to change the source of foreign exchange information at any time.

The Temperley gift coin will expire after 12 months from the date of its purchase. At the end of that period any unused balance will be forfeited.

When you use the Temperley gift coin, the amount of your purchase will be deducted from the balance on the coin. Change will not be given. The balance may be applied to future purchases.

You may obtain information about the remaining balance on the coin by contacting the location where your coin was originally purchased.

The Temperley gift coin cannot be redeemed or exchanged for cash, other gift coins or store credit.

The Temperley Gift Coin should be treated as cash, as Temperley is unable to replace it if lost or stolen.

You can top up your coin by visiting our London, Notting Hill location or by calling e-commerce customer services.

Refunds will not be given for the purchase of a Temperley gift coin.

All refunds/exchanges of goods purchased with the Temperley gift coin will be made in accordance with Temperley's refund policy. This does not affect your statutory rights.

Temperley will cancel the value of the gift coin if we fail to receive payment from the purchaser's bank or card company for the initial purchase of the coin.

Temperley reserve the right to add to or amend these terms and conditions from time to time, where we consider it reasonable and necessary to do so for security, regulatory or other legal reasons. Reasonable notice will be given where possible.

Temperley reserve the right to refuse to accept a gift card in payment or part payment of any item where it reasonably suspects that the card or any amount on it may have been stolen or obtained in another illegal way.
